Man alleges Powerbuilt tool was defective, caused loss of eye

PITTSBURGH – A Parker man has filed a suit against an auto parts business and an automotive tool maker over allegations he lost an eye because of a defective tool.

Joshua Ross filed a complaint in the Allegheny Court of Common Pleas against Advance Auto Parts Inc. and Powerbuilt Inc. alleging negligence, strict liability and breach of warranty.

According to the complaint, the plaintiff rented a Powerbuilt Upper Control Arm Bushing Service Kit from Advance Auto Parts in on June 13, 2018. The plaintiff alleges he was using the tool in the manner that was meant by the defendants but part of the assembly broke while in use, causing metal shrapnel to strike his face. He alleges he lost his right eye, sustained nasal bone fractures and other injuries as a result. 

The plaintiff alleges Advance Auto Parts supplied and/or leased a product it knew or should have known was defective and Powerbuilt allegedly designed and manufactured defective bushing kits.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by David I. Ainsman and Erin K. Rudert of Ainsman Levine LLC.
