McKeesport couple allege defective Ameristep tree stand caused fall, injuries

PITTSBURGH – A McKeesport couple allege a defective tree stand caused the husband to fall 15 feet while hunting.

Timothy Babyok and Lori Babyok filed a complaint in the Allegheny County Court of Common Pleas against Dick's Sporting Goods Inc., Tashin Industrial Corp. USA and Ameristep Corp. alleging strict liability, negligence and breach of warranty.

According to the complaint, Timothy Babyok was hunting on Oct. 6, 2018, using an Ameristep tree stand purchased from Dick's and distributed by Tashin. The suit states the tree stand's cables snapped and the plaintiff fell 15 feet to the ground and sustained permanent injuries.

The plaintiffs are seeking more than $35,000, attorney fees and court costs. The plaintiffs are represented by Anthony J. Giannetti of Swartz Culleton PC in Pittsburgh.
