Former Walmart employee alleges age was factor in termination

PITTSBURGH – A Latrobe woman is suing Walmart alleging that she was unfairly terminated due to her age and because she took time off to care for her health.

Brenda Spor filed a complaint on April 30 in the Allegheny County Court of Common Pleas against Walmart Stores East Inc., doing business as Walmart Stores East LP, and Walmart citing discrimination under the Age Discrimination in Employment Act.

According to the complaint, the plaintiff began her employment with the defendants in June 2010 and is 61 at the time she filed the complaint.

The plaintiff alleges she began to have to take time off of work while employed by the defendant because of health conditions. She alleges she suffered an injury in 2017 that forced her to take temporary disability leave and when she returned in June 2017, she had to take intermittent leave. 

The plaintiff alleges following her injury, she was treated worse than her co-workers who were younger than 40 years of age and on Feb. 21, 2018, she was terminated from her position after she had been late to work earlier that year because of a doctor's appointment.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by Peter T. Kobylinski of Preatorian Law Group LLC.
