Woman alleges vomit on floor at Monroeville Mall caused fall, concussion

PITTSBURGH – A Pittsburgh woman alleges she sustained a concussion after slipping in vomit at a Monroeville mall.

Linda O'Toole filed a complaint in the Allegheny County Court of Common Pleas against CBL/Monroeville LP, doing business as Monroeville Mall; CBL & Associates Properties Inc., doing business as Monroeville Mall; ERMC; Secure America; and ERMC II LP, doing business as ERMC Security, alleging negligence.

According to the complaint, on July 28, 2018, the plaintiff was at the Monroeville Mall and slipped and fell because of vomit on the floor. She alleges she sustained a concussion and other injuries to her head and upper back.

She alleges the defendants failed to maintain the premises and failed to provide sufficient warning. 

The plaintiff is seeking more than $35,000, attorney fees and court costs. The plaintiff is represented by Marc I. Simon of Simon & Simon PC in Pittsburgh.
