Citizens for Pennsylvania's Future alleges Philadelphia recycling facility unlawfully discharges storm water

PHILADELPHIA – A nonprofit environmental organization alleges the operator of a Philadelphia recycling facility is unlawfully discharging polluted storm water.

Citizens for Pennsylvania's Future filed a complaint on June 11 in the U.S. District Court for the Eastern District of Pennsylvania against Greendog Recycling Inc. citing the Federal Water Pollution Control Act, also known as the Clean Water Act.

According to the complaint, the defendant is the operator of a scrap metal processing and recycling facility in Philadelphia. The plaintiff alleges the defendant discharges polluted storm water runoff from the facility into U.S. waters without authorization. The suit states the defendant has failed to obtain a permit in violation of the Clean Water Act.

The plaintiff is seeking to enjoin the defendant from discharging pollutants, for the defendant to pay civil penalties and court costs. The plaintiff is represented by its staff attorney Alice R. Baker in Philadelphia.
