West-Aircomm Federal Credit Union allegedly failed to provide proper notice when repossessing vehicles

PITTSBURGH – A Monaca woman alleges she was not provided proper notice of disposition of collateral when her cars were repossessed.

Helena Haddad, individually and on behalf of all others similarly situated, filed a complaint in the Allegheny County Court of Common Pleas, against West-Aircomm Federal Credit Union alleging violation of Pennsylvania's Uniform Commercial Code.

According to the complaint, on March 21, 2013, the plaintiff purchased a used 2012 Chevrolet Captiva and a used 2013 Chevrolet Cruze that were financed through the defendant. The suit states the plaintiff fell behind on payments in summer 2014 and the defendant repossessed the vehicles or ordered a party to repossess them on Oct. 2, 2014. 

The plaintiff alleges state law requires a post-repossession notice to be sent to the borrower and that the notice sent to her by the defendant failed to advise her of the time and date of the sale, method of intended disposition and other information.

The plaintiff is seeking statutory damages, attorney fees and court costs. The plaintiff is represented by Clayton S. Morrow of Morrow & Artim PC in Pittsburgh and Emily S. Gomez-Hayes of the Law Office of Emily Gomez of Pittsburgh.
