Couple allege chair purchased from Pier 1 injured wife when it lost balance, caused fall off deck

PITTSBURGH – A Washington County couple allege that the wife was injured while sitting in a chair purchased from Pier 1 Imports.

Penny Wetzel and David Wetzel filed a complaint on June 3 in the Washington County Court of Common Pleas against Pier 1 Imports Inc., alleging strict liability, breach of warranty and negligence. Pier 1 has removed the case to the U.S. District Court for the Western District of Pennsylvania.

According to the complaint, on July 4, 2017, Penny Wetzel was sitting in a Swingasan chair on her deck that was purchased from the defendant. The suit states while sitting in the chair, it suddenly lost its center of balance, tipped, and caused her to fall from the chair and off of her deck.

The plaintiffs allege the defendant owed a duty of care to sell products that were free from defects.

The plaintiffs are seeking all reasonable sums due, attorney fees and court costs. The plaintiffs are represented by Anthony C. Mengine of Kontos, Mengine, Killion & Hassen in Pittsburgh.
