Man alleges Irgse Racing stole equity, kicked him out of his own company

PHILADELPHIA – A Lehigton man alleges he was "thrown" out of his company by two organizations based in New York and Florida.

Dennis Macchio filed a complaint on Aug. 23 in the U.S. District Court for the Eastern District of Pennsylvania against Bertil Roos Road Racing LLC and Irgse Racing LLC alleging breach of contract and other counts.

According to the complaint, the plaintiff purchased Bertil Roos Racing School in 1999. In 2017, the plaintiff alleges he was approached by IRG, which expressed an interest in partnering with the plaintiff on a joint venture. The defendant allegedly offered to form a new company, Bertil Roos Road Racing LLC, and the defendant would own 70 percent of the company while the plaintiff would own 30 percent. The plaintiff alleges he agreed to the terms of the agreement. 

The plaintiff was terminated on July 23 for cause, the suit states.

"In short, IRG and Bertil Roos have thrown Macchio out of his company, stolen his equity and are preventing him from earning a living," the suit states.

The plaintiff is seeking actual, punitive and statutory damages; attorney fees; and court costs. The plaintiff is represented by Jonathan R. Cavalier of Cozen O'Connor in Philadelphia.
