PHILADELPHIA – An employee at a Philadelphia physical therapy facility who was struck in the head when a piece of a ceiling lift fell on her is seeking damages from the lift's manufacturer.
Shirrelle Brooks filed a complaint Oct. 2 in the Philadelphia County Court of Common Pleas against Guldmann Inc. alleging liability, negligence and breach of warranty.
On April 10, Brooks alleges she was transferring a patient at Good Shepherd Penn Partners with a ceiling lift when a metal piece of the lift fell off and hit her forehead, causing head trauma, scarring and post-concussion syndrome, according to the suit.
The plaintiff alleges the defendant failed to properly equip the ceiling lift system and its parts with a proper safeguard to prevent it from malfunctioning and/or failing.
Brooks seeks monetary damages of more than $50,000 and other just relief. She is represented by Brandon Swartz and Bryan Ferris of The Swartz Culleton Law Firm PC in Newtown.
The case was removed to the U.S. District Court for the Eastern District of Pennsylvania on Oct. 23 by the defendant.
