Lawsuit filed against Medical Alert over telemarketing calls

PHILADELPHIA – A Pennsylvania man has initiated a class action against Medical Alert over allegations it unlawfully called him to sell its services.

Joseph Roberts, individually and on behalf of all others similarly situated, filed a complaint Dec. 6 in the U.S. District Court for the Eastern District of Pennsylvania against Connect America.com LLC, also known as Medical Alert, and Does 1 through 10 alleging violation of the Telephone Consumer Protection Act (TCPA).

According to the complaint, the defendant began to contact Roberts on his cellphone number using an automatic telephone dialing system in an effort to solicit its services/products. He alleges he did not give prior consent to receive the calls and that his number was on the National Do-Not-Call Registry and that he requested the calls to stop.

Roberts seeks up to $1,500 in damages for each call in violation of the TCPA, a trial by jury and all other just relief. He is represented by Cynthia Levin with The Law Offices of Todd M. Friedman PC in King of Prussia.
