Young woman claims McDonald's manager showed her sexually graphic photos on his phone during job interview

PHILADELPHIA – A young woman is suing McDonald's after a manager allegedly showed her sexually graphic photos on his phone during her job interview. 

Jane Doe filed a complaint Dec. 16 in the U.S. District Court for the Eastern District of Pennsylvania against McDonald's USA LLC and Tanway Enterprises LP alleging violation of the Civil Rights Act of 1964, Pennsylvania Human Relations Act, Philadelphia Fair Practices Ordinance and Pennsylvania common law.

The suit states Doe, who was 16 years old at the time, attended a scheduled interview at a Philadelphia McDonald's in April 2018. She alleges in her complaint that during her job interview, the male manager conducting the interview asked to go through her phone "so that he could 'continue to investigate' who she was as a person."

She claims he then began to ask if she was having sex with her boyfriend, then allowed her to look at his phone which contained "sexually graphic" photos of women and himself.

The plaintiff alleges she was offered the position but the defendants constructively discharged her the same day she and her mother filed a police report.

The plaintiff alleges the defendants' conduct was emotionally damaging and humiliating.

Doe seeks economic damages, a trial by jury and all other just relief. She is represented by Caroline Miller of the Derek Smith Law Group PLLC in Miami.
