Wawa faces suit over 2019 data breach

PHILADELPHIA – Wawa is facing a lawsuit over its 2019 data breach involving transactions at nearly all of its convenience stores. 

New Jersey resident Joseph Muller, on behalf of himself and all others similarly situated, filed a complaint Dec. 26 in the U.S. District Court for the Eastern District of Pennsylvania against Wawa Inc., alleging negligence, breach of contract, violation of the Pennsylvania Unfair Trade Practices Act and Consumer Protection Law and the New Jersey Consumer Fraud Act.

The suit states "millions" of consumers credit and debit card numbers were stolen by a computer hacker and the breach involved transactions at the majority of the defendant's 850 convenience stores. The suit states the data breach took place between March 4 and Dec. 12, 2019.

Muller alleges Wawa failed to properly safeguard his and other customers' credit and debit card information. He also claims Wawa has a history of "credit card intrusions" dating back to 2013.

Muller seeks damages, a trial by jury, interest and all other just relief. He is represented by Sherrie Savett, Shanon Carson and Jon Lambiras of Berger Montague PC in Philadelphia and E. Michelle Drake of Berger Montague PC in Minneapolis.
