Lawsuit: Man run over by motor scooter at Walmart sustained concussion

PITTSBURGH – An East McKeesport man who allegedly suffered a concussion after being struck by a motorized scooter at a Walmart is seeking damages.

Emil Kolesar filed a complaint in the Court of Common Pleas of Allegheny County against Walmart Inc., doing business as Walmart Supercenter No. 2588; Amigo Mobility International Inc.; and Jane Doe alleging negligence and product liability.

Kolesar, who was 84 at the time, alleges he was shopping at the Walmart in North Versailles on Oct. 31, 2017. According to the suit, Kolesar was standing in an aisle looking at the cereal when he was struck by a scooter owned by Walmart and driven by a Jane Doe, who failed to stop. 

The suit states Kolesar was thrown, his head hit the floor and he lost consciousness for several minutes until he was revived by paramedics. He blames his injuries on the aisle being blocked due to employees unloading boxes, the defective condition of the scooter and Doe's negligent operation. 

The suit states the scooter was manufactured by Amigo Mobility.

Kolesar seeks more than $35,000, interest and all other proper relief. He is represented by Richard C. Thiele.
