Erie County family files lawsuit against North East School District following child's removal from campus

ERIE – An Erie County family is suing the North East School District and three individuals who allegedly violated their grandchild’s 14th Amendment rights.

Michael C. and Wendy C. filed a lawsuit as the legal guardians representing for the minor plaintiff on Dec. 30 in the Western District Court of Pennsylvania. Plaintiffs claim the school failed to protect their grandchild from being harassed and falsely imprisoned.

The minor was allegedly taken off school grounds by defendant Charlotte Eidell, a teacher’s aide at Earle C. Davis Primary School. She allegedly covered the minor’s mouth and dragged the minor to a secure area from which she then left the school grounds, taking the minor to defendant Shelly Jageman’s residence and leaving the minor with her. 

The plaintiffs are seeking compensation of grievances for the alleged violation of the minor’s civil rights as well as medical expenses due to alleged emotional distress, pre- and post-judgment interest, punitive damages and cost of suit. Plaintiffs are being represented by the law offices of Joel Sansone, Joel S. Sansone, Massimo Terzigni and Elizabeth Tuttle of Pittsburgh. 

This case is assigned to Circuit Judge Susan Paradise Baxter.
