Lawsuit against Red Cross over lifeguard trainees swimming into each other being heard in federal court

PHILADELPHIA – The U.S. District Court of Eastern Pennsylvania is presiding over a lawsuit brought against the American National Red Cross in November 2019.

District Judge Nitza Quiñones Alejandro is hearing the case, which was removed to her court on Dec. 31 through an argument that the claim is over the $50,000 minimum required for removal from state to federal court.

Plaintiff Steve Jones alleges the American National Red Cross and its co-defendants, Indian Valley Family YMCA and The North Penn Young Men’s Christian Association practiced carelessness during a lifeguard training exercise. 

The alleged negligence resulted in Jones sustaining injuries after swimming into a fellow lifeguard heading in the opposite direction of Jones while they were partaking in the training exercise. This allegedly caused Jones to become dizzy and lose consciousness after he exited the pool, where he allegedly hit his head when he fell. 

The American National Red Cross is being represented by Julie Buonocore of Rebar and Bernstiel of Princeton, New Jersey.
