MEDIA — A Downington couple are suing P.F. Chang’s because of an alleged incident at its Glen Mills restaurant.
Gerald and Amy Ashmen filed a complaint March 2 in the Delaware County Court of Common Pleas seeking more than $50,000 in damages. According to the lawsuit, Amy Ashmen was dining at the restaurant on Aug. 8, 2018, when an employee carrying a tray full of dishes “was walking briskly down the center aisle when suddenly and without warning he struck Mrs. Ashmen in the back of the head with the tray of dishes.”
The complaint said the employee, the server and manager apologized. Ashmen said the server told her employees “were trained not to carry serving trays below the height of their shoulders and that they were supposed to carry them up high in order to avoid striking patrons with the trays.”
The Ashmens said the employee and restaurant were careless and negligent. Amy Ashmen alleged she “sustained multiple serious injuries, some or all of which may be permanent in nature and may have aggravated pre-existing conditions, including: trauma to her head and neck; cervical strain and sprain; cervical disc injuries; a closed head injury; traumatic brain injury; concussion; post-concussion syndrome; post-traumatic headaches and migraines; and occipital neuralgia.”
