Cozen O'Connor attorneys face legal malpractice, conflict of interest claim from client

PHILADELPHIA — A business owner is claiming legal malpractice against attorneys at a Pennsylvania firm who advised him on the sale of his companies.

Adam Potter and Moxie HC LLC filed a complaint April 7 in the U.S. District Court for the Eastern District of Pennsylvania against Cozen O'Connor, Anne Blume, Ann Madonia, and The Institutes alleging breach of fiduciary duty, negligence, legal malpractice and unjust enrichment. 

Potter, the sole member of Moxie HC, sold three business on June 1, 2018, with attorneys Blume and Madonia of Cozen O'Connor advising him on the sale. Potter alleges a year after the sale, he learned he did not receive fair value for his businesses and claims Cozen O'Connor attorneys failed to recommend an appraisal of the business. 

Potter also alleges Blume, who became CEO of the purchaser right after the sale, had a conflict of interest.  

Potter seeks monetary relief of more than $150,000, trial by jury, and all other just relief. He is represented by Clifford Haines of Haines & Associates in Philadelphia.
