Philadelphia police officers are accused of fabricating evidence, giving false testimony

PHILADELPHIA — The City of Philadelphia and several of its police officers have been sued by a man who claims his narcotics arrest, house arrest and probation were the result of fabricated evidence and false testimony.

Michael McClary filed a complaint April 15 in the U.S. District Court for the Eastern District of Pennsylvania against the City of Philadelphia and Officers Christopher Hulmes and Doe 1-3 alleging civil rights violations. 

McClary was arrested March 4, 2011, after Hulmes claimed he saw him engaged in a narcotics deal. McClary alleges Hulmes, who later pleaded guilty to perjury, tampering and other illegal behavior, had no probable cause for his arrest; that he was not in possession of any narcotics; and that the defendants fabricated evidence and testimony. Prior to McClary's conviction being reversed on Feb. 28, 2020, he served six months of house arrest and two years of probation. 

McClary seeks monetary relief, trial by jury and all other just relief. He is represented by Attorney Michael Pileggi of Philadelphia.
