Lawsuit: Counties of Delaware, Chester and Bucks aren't maintaining voter lists

HARRISBURG – A nonprofit is suing several state and county officials in Pennsylvania in order to ensure certain voters are removed from registration lists.

Judicial Watch filed its lawsuit April 29 in Harrisburg federal court against Pennsylvania Secretary of State Kathy Boockvar, as well as elections officials in Bucks, Chester and Delaware counties.

The lawsuit is brought under the National Voter Registration Act, which requires voters be removed from a jurisdiction’s voter rolls if he or she confirms in writing that they have moved outside the jurisdiction or fails to respond to an address confirmation notice then fails to vote in the next two general federal elections.

Judicial Watch feels that figures shown in an Election Assistance Commission report reflect that the three counties have removed almost no voters recently.

Removals throughout Pennsylvania are “absurdly low,” the group says.

“Allegheny County only took action regarding this failure after receiving notice from Judicial Watch on Dec. 11,” the lawsuit says.

“Secretary Boockvar took no action regarding Allegheny County and defended its list maintenance practices as late as March 2020, despite the widely publicized admission by County officials of this multi-year failure to comply…”
