The U.S. District Court for the Western District of Pennsylvania reported the following activity in the suit brought by
Three Rivers Hydroponics LLC against
Florists' Mutual Insurance Company and
THE Hartford Steam Boiler Inspection and Insurance Company on Aug. 1: 'Order Regarding Further Proceedings. Based On The Matters Set Forth At 272 , The Briefing Order At 268 Is Alive And Well. The Clerk Will Lift The Stay, And Reopen The Case On The Docket For Further Proceedings. While The Court Will, Of Course, Consider Any Further Matters Or Requests Brought To The Courts Attention By Any Party Or The Parties Jointly On Their Own Merits, The Court Would Make The Following Observations. This Matter Has Recently Proceeded To Two (2) Adr Proceedings, The First Before One Of The Most Experienced Adr Neutrals In The District (particularly For Commercial Disputes Such As This One), And Then Before A District Judge Of This Court Who Brings To Such Tasks Twenty + Years Of Experience In Conducting Conciliation Conferences In Civil Cases. Nonetheless, This Eminently Resolveable Civil Commercial Dispute Has Not Resolved. That Is, Of Course, The Choice Of The Parties, Which The Court Respects. However, In Light Of The Above, Any Party Tempted To Request That The Court Further Pause The Proceedings For Further Adr Is Advised In Such Regards To Think Hard, And Then Think Hard Again. Camreta V. Greene, 131 S. Ct. 2020, 2032 (2011). The Order At 268 Will Involve A Lot Of Work For All Of The Parties And Their Lawyers, And Then Some More Work For The Court. The Latter Is Fine With The Court, The Former A Very Substantial Expense For The Parties And Their Lawyers. So, The Court Makes This Admonition Simply To Remind The Parties That If They Will Seek To Resolve This Commercial Dispute, In The Courts Estimation, Now Is The Time. Those Matters Are Unlikely To Get Better With Age. The Stay Is Lifted, The Action Reopened On The Docket, And The Court Anticipates Compliance With The Timelines Set Out In 268 .
