MEDIA - A Chester woman is suing seven different defendants for a culmination of injuries sustained when she was allegedly pushed off a loading dock when operating a loading dock lever in 2019, according to court documents from the Delaware County Court of Common Pleas.
The defendants in the February civil suit are: Elmwood Four, LLC; Henderson Elmwood IV Associates, LP; Henderson Group, Inc.; Apria Healthcare, LLC; Apria Healthcare, Inc.; Apria Healthcare of New York State, Inc.; and Systems, LLC.
According to the complaint, on Feb. 13, 2019, Angela Jacobs was backing a delivery truck up to a loading dock with a dock leveler manufactured, installed and maintained by defendant Systems, at a commercial location leased by the defendants Apria Healthcare and owned by the defendants Elmwood GP, Elmwood LP and Henderson Incorporated.
Jacobs reportedly pulled on a lever to deploy the dock leveler; the lever "snapped back suddenly, without warning and with great force," allegedly causing Jacobs to fall from the dock and suffer serious and permanent injuries to the head, neck, back, left leg and shoulders, along with several cuts, abrasions, bruises, lacerations, internal organ damage and emotional trauma.
Jacobs filed for damages totaling $50,000 from each Apria Healthcare defendant and Systems, LLC, and has requested trial by jury. She is represented by Silvers, Langsam & Weitzman, PC.
