Lansdale Big Lots sued for at least $50K by woman who tripped on frame in aisle

MEDIA - A Lansdale woman is suing Big Lots Stores, Inc. after she allegedly tripped on a wooden frame that had fallen off an overflowing, unattended restocking cart at the Lansdale Big Lots, according to documents filed in the Delaware County Court of Common Pleas. 

The plaintiff, Dianitza Neito-Kuller, was shopping in the store in May of 2019 when she tripped over the frame which was reportedly unavoidable yet concealed in the aisle, says a complaint filed Feb. 4.

Neito-Kuller is seeking damages for "severe and potentially permanent physical injuries and scarring, severe pain, anxiety, depression, emotional distress, embarrassment, loss of life's pleasures and enjoyment of life."

The plaintiff is suing for one count of negligence, including failure to inspect the store for hazardous conditions, failure to provide adequate lighting to illuminate the dangerous condition and violating a Property Maintenance Code, and is seeking compensation in excess of $50,000.
