PHILADELPHIA - A Montoursville Area School District sixth-grade teacher and assistant baseball coach is seeking damages from multiple defendants after a baseball allegedly ripped through polyethylene safety netting and struck him in the right eye, causing surgical removal of the eye in addition to other injuries.
According to documents filed in U.S. District Court for the Eastern District of Pennsylvania on Feb. 19, Corey Twigg was hosting indoor batting practice in March 2019 with batting cage and safety equipment manufactured by the following defendants: Varsity Brands Holding Co. Inc., BSN Sports, Inc., Sport Supply Group, Inc., Spartan Athletic Company and Gold Medal Athletic Products.
The suit states that the batting net and its equipment was marketed and promoted as being safe for use.
Twiggs is suing for: one count of strict product liability, manufacturing defect and design defect, one count of strict product liability, failure to warn and one count of negligence. His spouse, Lori Twigg, is suing for one count of loss of consortium and one count of punitive damages.
The plaintiffs are demanding judgments for loss of wages, loss of earning capacity, mental and physical suffering, medical expenses and injuries and punitive damages.
