Amazon accused of firing Pennsylvania man for marijuana use when he has a medical marijuana license

PHILADELPHIA - A former Amazon employee sued the online retail giant in the Eastern Pennsylvania District Court after he was allegedly terminated due to marijuana use despite having a medical marijuana license, according to documents filed on March 1. 

Plaintiff Nathan Miller worked at the Amazon Fulfillment Center in Carlisle in a seasonal position. Miller says that the defendant, including his immediate supervisors, knew that he carried a valid medical marijuana license due to his severe post-traumatic stress disorder (PTSD), anxiety and depression. 

The plaintiff says he had a record of stellar and productive employment. 

In July 2020, Miller applied with Amazon to make his seasonal position permanent. He was informed that he had to successfully complete a drug test through the Quest Diagnostics Clinic Laboratories, also named as a defendant in the case, before hiring. 

Despite allegedly informing multiple people at every step in the drug screening process both with Amazon and Quest, Amazon Human Resources told Miller that he had failed the drug test due to marijuana and was terminated. 

Amazon and Quest are sued for one count of violation of the Medical Marijuana Act, one breach of contract/breach of implied covenant of good faith and fair dealing, violation of public policy, intrusion on seclusion and civil conspiracy. 

Miller is seeking judgements deemed appropriate by the court. He is represented by the Derek Smith Law Group LLC of Philadelphia.
