You don't have a friend in me: Lifelong pals now locked in lawsuit after one complains he was punched too hard

PITTSBURGH - Two lifelong friends are now locked in a civil lawsuit because one says the other punched him in the shoulder too hard, according to documents filed in February in the Allegheny County Court of Common Pleas. 

Plaintiff Albert J. Agostinelli of Pittsburgh has been friends with James W. Stevenson of Bethel Park for more than 30 years, the lawsuit said. In April 2019, the two were both at a track and field meet at Bethel Park High School, where the plaintiff was watching his niece compete. 

When Agostinelli approached Stevenson at the athletic field to say hello, the defendant allegedly gave the plaintiff a friendly punch on the shoulder. 

The plaintiff complains that he felt immediate pain in his shoulder and suffered serious injury, including muscle weakness, a partial rotator cuff tear and a reduced range of motion. 

The plaintiff charged his friend with negligence with a price tag of at least $35,000 in damages.
