Ongoing order that protects renters from eviction is unfair for landlords, lawsuit complains

PITTSBURGH - The Centers for Disease Control (CDC) and four national executives were sued in Pennsylvania federal court by a landlord advocacy group that's had enough of the pandemic-related eviction protections for renters. 

Plaintiff Landlord Service Bureau Inc. says that the halt on residential evictions, which was initiated in September of 2020 and was set to expire in December but has been extended through the end of March, is unfair, unlawful and damaging to landlords. 

The Bureau represents more than 4,200 landlords throughout Westmoreland and Allegheny Counties. It complains that landlords should be allowed to evict people from their properties and re-lease the property to someone who can pay rent. 

The suit requests declaratory judgement and injunctive relief as the CDC order allegedly constitutes an illegal impairment of contracts in violation of the U.S. Constitution, exceeds statutory and regulatory authority and unconstitutionally exercises legislative power. 

The Bureau asks the court to forbid the eviction protection order from being enforced. It is represented by Jones, Gregg, Creehan and Gerace LLP of Pittsburgh.
