Drexel Hill man suing over changing room bench collapse at K&G Men’s Company

MEDIA - A Drexel Hill man is suing the Marple Springfield Center, Inc., K&G Men’s Company and Blank Aschkenasy Properties, alleging negligence related to a fall he experienced involving a changing room bench.

The suit was filed by attorney Justin M. Bernstein on behalf of plaintiff Andrew Sumpter in the Delaware County Court of Common Pleas, according to court documents.

In his suit, Sumpter alleges that the bench in question was “broken, damaged and/or degraded,” which condition led to the bench collapsing when he sat on it during a May 26, 2019, visit to K&G Men’s Company. He also alleges that he was in the changing room for the expected purpose of trying on clothing.

The suit alleges that Sumpter sustained “serious and permanent injuries” requiring surgery to his right hip. It also alleges that he has had to expend “various sums of money” for medicine and medical treatment related to the injuries.

Sumpter alleges that he has also had to miss work due to his injuries sustained during the alleged incident, leading to losses of “earnings and/or earnings capacity.”

Sumpter is seeking in excess of $50,000 in damages, together with interest, costs and compensation for delay.
