Tesla sued for trying to tack on tens of thousands in extra fees for solar roof clients

PHILADELPHIA - Tesla Inc. is pinned in a class action lawsuit after the tech and vehicle company allegedly breached its contracts with its solar roof clients.

The complaint was filed on April 30 in the U.S. District Court for the Eastern District of Pennsylvania by plaintiffs Philip Dahlin and Mary Arndtsen, a husband and wife who contracted Tesla for approximately $46,000 to implement the defendant's solar shingles on their home in New Hope. 

According to the complaint, the contract between the plaintiffs and defendant included a maximum time frame that Tesla had to start the installation of the project.

The plaintiffs say they made multiple attempts to contact Tesla as the window approached and then past the last day that Tesla should have started the installation. 

Tesla contacted the plaintiffs more than a month after the contractually obligated final start day to inform them that the price for the solar system had changed and that they now owed more than $30,000 more on the contract that had already been finalized. 

According to the complaint, Tesla CEO Elon Musk said during a late April earnings call that the defendant "made some significant mistakes" in calculating the solar shingles' pricing. 

Tesla is charged with breach of contract, violation of the Home Improvement Consumer Protection Act and violation of the Pennsylvania Unfair Trade practices and Consumer Protection Act.

The plaintiffs are represented by LeVan Muhic Stapleton LLC of Philadelphia and Carlson Lynch LLP of Pittsburgh.
