Lawsuit over fight says one man beat the other with a police baton at 1:30 a.m.

PITTSBURGH - Two Allegheny County men are locked in a civil suit after one allegedly attacked the other with a police baton.

The complaint was filed in the Allegheny County Court of Common Pleas by plaintiff Luke Heller, who accuses defendant Austin Deutsch of beating him over the head with a police baton in the early morning hours of November 1, 2020. 

According to the complaint, criminal charges in regard to the attack are pending. 

Heller says he suffered a concussion, scalp laceration and other injuries from the assault. 

Deutsch is charged with civil assault and battery, and Heller requests damages outside of the court's limits. The short complaint does not specify why the two men were fighting or why Deutsch had access to a police baton.

The plaintiff is represented by Woomer and Talarico LLC of Pittsburgh.
