Child care facility worker hits head after fall, claims negligence

MEDIA —  A child care facility is facing a lawsuit after an employee suffered severe injuries after falling and striking her head.

Johanna Albert and Nicholas Albert filed a complaint May 18 in the Court of Common Pleas of Delaware County against St. Martin's Church, St. Martin's Church, Radnor and John Does 1-5 alleging negligence and premises liability. 

According to the plaintiff's complaint, Johanna Albert was working for Les Petits Cherubs on King of Prussia Road in Radnor on Aug. 5, 2020. She alleged that as she was attempting to leave the basement, she slipped on an "unknown substance" and fell and struck her head on the circuit breaker box. 

The plaintiffs claim Johanna Albert suffered a concussion, nausea, "eye movement abnormalities," poor endurance and "impaired tracking and gaze stabilization." They further claim Albert suffers from neck and shoulder tenderness, headaches and anxiety. The plaintiffs allege that St. Martin's failed to keep their premises in a safe condition, failed to inspect their premises, failed to recognize and correct the hazard or warn of the dangerous condition. 

The plaintiffs seek monetary relief of more than $50,000 and all other just relief. They are represented by Brandon Swartz and Matthew McElvenny of Swartz Culleton PC in Newtown.
