Woman brings civil action complaint against Philadelphia College of Osteopathic Medicine

PHILADELPHIA - A nurse claims she suffered discrimination, harassment and a hostile work environment based on ethnicity and race at her former employer.

Andrea Mudie filed a civil action complaint on May 11 in the U.S. District Court for the Eastern District of Pennsylvania against Philadelphia College of Osteopathic Medicine (PCOM), PCOM Family Medicine and Officer Manager of PCOM Family Medicine Charles Pascall.

According to the complaint, Mudie is Black and is an immigrant to the United States from Trinidad and worked for the PCOM Family Medicine Healthcare Center for more than a year. She alleges comments like she does not understand the "American way," and needs to go out and learn about America. 

Pascall allegedly called Mudie "a liar" about personal purchase of a home, refused her time for lunch, only allowed time off for her if she provided documentation first.

Pascall allegedly would threaten her job with being replaced and said that all outsiders do not belong in the U.S., including Mudies, who says she made several complaints to the HR department, but nothing was done about the situation. On Nov. 5, 2019, a week after Mudie's last complaint to HR, she was notified of being terminated without reason, the lawsuit says. 

Mudie seeks front and back pay and otherwise lost and future benefits, payment of compensatory and punitive damages and attorneys’ fees and costs of suit. Mudie is represented by David A. Berlin of Weisberg Law and Gary Schafkopf of Schafkope Law LLC.
