Couple sue Subway for negligence after soda machine falls on customer

LANCASTER -- A woman claims suffering after a soda machine part that houses the ice allegedly crashed on top of her head and face, knocking her glasses off. 

Colleen and Rodney Marshall filed a complaint on May 12 in the Court of Common Pleas of Lancaster County Pennsylvania against Bake, Inc d/b/a Subway #24838 for negligence and loss of consortium.

According to the complaint, Colleen Marshall purchased food on Jan. 27, 2020, at Subway located at 711 Woodhall Drive in Willow Street. Marshall alleged that after receiving her food, she went to the soda machine to get a drink. 

During that time, Marshall alleged that the top of the soda machine that holds the ice struck her face, knocking off her glasses, and also struck the top of her head. Marshall alleges that the part of the machine that struck her was held together by silver duct tape and a "clip".

The Marshalls seek $50,000 and interest and cost thereon, as allowed by the law. The Marshalls are represented by Thomas F. Lovecchio of Atlef Hall LLP.
