PITTSBURGH — A couple have filed a lawsuit against the City of Pittsburgh after the wife allegedly fell on a city park walking trail and suffered multiple injuries.
Ruth Banovatz and John Banovatz filed a complaint May 26 in the Court of Common Pleas of Allegheny County against the City of Pittsburgh alleging negligence.
The Banovatzes allege in their complaint that they were on the walking path at a park in Pittsburgh's Northside known as the "West Allegheny Commons or Allegheny Commons" on July 13, 2019. They claim that while on the walking trail, Ruth Banovatz fell due to a "defective condition" and suffered injuries to her elbow, wrist, shoulder, lower extremity, muscles, ligaments, tissues, tendons and nerves.
In addition, they claim her injuries have resulted in disfigurement, scarring, lost wages and medical treatment expenses. The Bonovatzes allege that the City of Pittsburgh was negligent for failing to keep its premises in a safe condition. They also allege the City of Pittsburgh failed to repair or replace the hazardous condition or to block off or warn of the defective condition.
The Banovatzes seek monetary relief, trial by jury and all other just relief. They are presented by Mark Milsop of Berger and Green PC in Pittsburgh.
