Suit alleges defective gas grill caused fire, property damage

SCRANTON — Allstate is alleging negligence on the parts of NexGrill and Home Depot after one of its insured suffered property damage when a grill caught on fire. 

Allstate Property and Casualty Insurance Company, as subrogee of Lisa Bauer, filed a complaint June 14 in the Court of Common Pleas of Lackawanna County against NextGrill Industries Inc., and Home Depot USA Inc., alleging negligence. 

Allstate alleges in its complaint that on April 11, 2020, its insured, Lisa Bauer, purchased a NextGrill gas grill that was purchased from and assembled by Home Depot. It claims that on Aug. 31, 2020, "a fire originated in the gas grill" and caused damage to Bauer's deck and other parts of her home in Scranton for which it paid a $13,725.54 claim. 

Allstate alleges NextGrill manufactured a defective grill and failed to use adequate materials and parts and failed to issue "proper warnings of a dangerous condition." It further alleges Home Depot was negligent for failing to discover the grill's defects, provide adequate instructions with the grill or warn of the dangers of the grill design.

Allstate seeks monetary relief of $13,725.54, interest and all other just relief. It is represented by Paul Sandler of Sandler & Marchesini PC in Philadelphia.
