PITTSBURGH — A roll truck operator claims he suffered serious injuries at a local landfill due to the negligence of another roll truck driver whose truck's tarp arm fell off and struck him.
Richard and Naomi Vanpool filed a complaint June 15 in the Court of Common Pleas of Allegheny County against Big's Trucking Inc., and William Bowen alleging negligence.
The plaintiffs claim in their suit that Richard Vanpool was operating a "roll-off truck" at the sanitary landfill in Westmoreland County on May 27, 2021. They allege that as Vanpool was attempting to undo his tailgate, Bowen, who was driving another roll-off truck for his employer, Big's Trucking, parked next to him.
The plaintiffs claim that the tarp arm on Bowen's truck broke off and struck Vanpool in the arm and caused him to suffer severe injuries including a broken arm which required surgical treatment. They further claim Vanpool has suffered mental anxiety and anguish as well as incurred medical treatment expenses as a result of the accident.
The plaintiffs allege Bowen's negligence for failing to park his truck "a safe distance away" from Vanpool's truck and that he negligently repaired the truck's tarp arm prior to the accident. They also claim Big's Trucking's negligence for failing to recognize previous accidents of its employees or to properly train or supervise its employees.
The Vanpools seek monetary relief of more than $35,000, trial by jury and all other just relief. They are represented by Adam Shorr and Anthony Giannetti of Swartz Culleton PC in Pittsburgh.
