Hotel guest attacked by another guest's dog claims negligence

SCRANTON — A guest at a Best Western hotel in Matamoras who was attacked by another guest's dog and suffered serious injuries is claiming negligence. 

Peter Duvaloois filed a complaint June 15 in the U.S. District Court for the Middle District of Pennsylvania against QBE Americas Inc., doing business as Best Western, Best Western International Inc., ABC Inc., 1-5, a fictitious corporation and John Doe 1-5 fictitious individuals alleging negligence. 

Duvaloois alleges in his complaint that while a guest at the Best Western on Route 6 and Route 209 in Matamoras on June 19, 2019, he was "severely bitten" by another guest's dog as he was walking in the hotel hallway. He claims the owner of the dog had been residing at the hotel for several days prior to the attack and that the defendants should have been aware of the dog's "violent propensities." 

Duvaloois also claims the defendants had "sufficient opportunity" to prevent the dog attack and negligently allowed the dog to roam "without any muzzle or restraint." He alleges the defendants were negligent in failing to "perceive the highly apparent danger" the dog posed to hotel guests and claims he has suffered injuries to his arm including neurological damage and disfigurement. 

Duvaloois seeks monetary relief of more than $75,000 and all other just relief. He is represented by Christopher Moyer of Master Weinstein Moyer PC in Philadelphia.
