Slip-and-fall lawsuit against Walmart claims merchandise caught his eye in dangerous spot

SCRANTON — A man who allegedly suffered a slip and fall at a Walmart claims the store negligently put items on a shelf to attract customers' attention near a dangerous condition. 

William Gerrity, Jr., filed a complaint July 6 in the Court of Common Pleas for Lackawanna County against Walmart Supercenter store #1884 and/or Walmart Inc., alleging negligence. 

Gerrity alleges in his complaint that he was at the Walmart in Dickson City on July 13, 2019, when he slipped, tripped and fell on a "substance on the unclean floors" and suffered serious and permanent injuries including to his head, hip, elbow, neck and back. 

He claims the substance "was on the floor for a sufficient amount of time" before he fell and that the defendants "had actual knowledge" of the hazard and that their inaction caused his fall. 

Gerrity alleges the defendants' negligence for failing to warn of the dangerous conditions and for their failure to place carpet or "other absorbent material" near the display or shelving. He also alleges Walmart failed to timely inspect or maintain the store premises and that the defendants "willfully put items on shelves designed to attract the customer's attention" near a dangerous condition. 

Gerrity seeks monetary relief of more than $50,000, trial by jury and all other proper relief. He is represented by Michael Pisanchyn, Jr., and Thomas Carroll, Jr., of the Pisanchyn Law Firm in Scranton.
