Suit alleges senior living facility's neglect, overmedication led to patient's death

PITTSBURGH — A Bethal Park senior living facility is facing a lawsuit alleging its overmedicating and neglect of a patient led to her fall, hip fracture, malnutrition and death. 

Kimberly Wagner, administrator of the Estate of June Voytell, filed a complaint July 16 in the Court of Common Pleas of Allegheny County against Paramount Senior Living at Bethel Park LLC and Paramount Health Resources Inc., alleging wrongful death and negligence. 

The plaintiff's mother, June Voytell, who had a history of falls, was admitted to Paramount Senior Living on April 27, 2017, according to the complaint.  Wagner alleges that on November 20, 2019, her mother had an "unwitnessed fall" in her room and suffered a hip fracture. 

She further alleges that her mother was transferred to Jefferson Hospital, where she underwent surgery to repair the fractured hip. Wagner claims her mother's injuries led to her physical decline and eventual death on July 6, 2020, and that Paramount overmedicated her mother with opiates and other medications. 

The plaintiff also claims Paramount failed to have fall prevention protocols, failed to address Voytell's fall risk and failed to properly monitor or provide her with proper nutrition which caused her to become frail and weak. 

Voytell seeks monetary relief, trial by jury and all other just relief. She is represented by Anthony Giannetti of Swartz Culleton PC in Pittsburgh.
