Shelf collapse at Lowe's leads to lawsuit

MEDIA — Lowe's is facing a lawsuit after a top shelving unit allegedly came down on a customer while he was shopping at its store in Brookhaven. 

Robert Jones and Tracy Jones filed a complaint Aug. 9 in the Court of Common Pleas of Delaware County against Lowe's Inc., doing business as Lowe's Home Improvement alleging negligence. 

The plaintiffs allege that Robert Jones was shopping at the Lowe's Home Improvement on Edgmont Avenue in Brookhaven on Feb. 8, 2020. They claim that as Jones was looking at merchandise on a shelf it came crashing down toward him. 

The plaintiffs allege that Jones suffered tendon damage as well as a tear and sprain and a bicep detachment. The Joneses further allege Lowe's' negligence for allowing the defective shelving to exist and failing to routinely inspect the aisles and shelves of the store to ensure merchandise was stacked and stored properly. 

They claim Lowe's also failed to warn of the dangerous condition and to properly train its employees on properly stacking and securing merchandise. They also claim Robert Jones has suffered mental anguish and that they have incurred medical treatment expenses as a result of the accident. 

The Jones seek monetary relief of more than $50,000 and all other just relief. They are represented by Arthur Sagoskin of Curtin & Heefner LLP in Yardley.
