Motorcyclist sues PennDOT after sliding on oil, stones in roadway

LANCASTER — A motorcyclist who suffered fractures ribs and other injuries after sliding on oil and stones on a roadway in Paradise Township is claiming the PennDOT's negligence. 

Christian Kaufmann filed a complaint Aug. 11 in the Court of Common Pleas of Lancaster County against the Commonwealth of Pennsylvania, Department of Transportation alleging negligence. 

According to his complaint, Kaufmann was driving his motorcycle on Rohrer Mill Road between Routes 741 and 896 in Paradise Township on June 12, 2020. He alleges that as he approached "a right to left curvature" in the road, the motorcycle slid on "oil and loose stones" that were on the roadway. 

Kaufmann claims his motorcycle went down on its side and slid into the grass and caused him to suffer serious injuries including fractures to his ribs and wrist and other bodily injuries. He alleges the defendant's negligence for failing to inspect the condition of the road and failing to remove the oil and loose stones from the surface of the road. Kaufmann further alleges the defendant failed to supervise the maintenance of the road and did not warn motorcycle operators of the dangerous condition. 

Kaufmann seeks monetary relief of more than $50,000, interest and all other just relief. He is represented by David Dessen of Dessen, Moses & Rossitto in Willow Grove.
