Lawsuit: Apartment tenant suffers injuries after ceiling collapse

PITTSBURGH — A tenant who suffered injuries in an apartment ceiling collapse is claiming negligence. 

Darnita McPhail filed a complaint in the Court of Common Pleas of Allegheny County against Lincoln Ave - PE LLC, Pittsburgh Properties Guity E-1 LLC, Pittsburgh Properties Guity E-2 LLC and M.J. Kelly Realty Corp., alleging negligence. 

According to the complaint, while in the bathroom of the plaintiff's rented apartment, the plaintiff was struck by a collapsing ceiling, fell and lost consciousness. The plaintiff suffered injuries including a fractured ankle, post-concussive syndrome, traumatic injuries to the lumbar spine, loss of earnings and incurred medical treatment expenses, the suit says. 

The plaintiff also claims damages of permanent scarring and disfigurement and costs for medical rehabilitation.  The plaintiff alleges the defendants' negligence for failing to design, construct, maintain and repair the ceiling and failing to inspect for defective conditions. The plaintiff also alleges the defendants were negligent for failing to warn of the defective ceiling or block off the defective area of the premises. 

McPhail seeks monetary relief of more than $75,000, trial by jury and all other just relief. She is represented by Marc Simon of Simon & Simon PC in Pittsburgh.
