MEDIA — A charter school student claims the school's lack of security led to her being bulled and assaulted by another student.
JM.G, a minor by and through her parent and natural guardian Lizbeth Rosario, filed a complaint Sept. 28 in the Court of Common Pleas of Delaware County against Chester Community Charter School alleging negligence.
According to the plaintiffs' complaint, JM.G. was a student at the Chester Community Charter School from kindergarten through fourth grade. They allege that on Feb. 21, 2020, as JM.G. was leaving music class, a fellow student told her he was going to assault her and caused her to run into the girl's bathroom to avoid the student who threatened her.
The plaintiffs claim that while in the bathroom, JM.G. was confronted by other students and was told by a teacher to leave the bathroom. They further claim that as JM.G. ran down the hallway to try and get away, the fellow student who threatened her pushed her to the ground as she was running. The plaintiffs claim the force of the push caused the minor to be "violently" thrown into the hallway cubbies and suffer injuries.
They allege the defendant's negligence for failing to keep the school premises safe and to properly monitor the hallways and bathrooms to ensure student safety or have adequate camera surveillance.
The plaintiffs seek monetary relief of more than $50,000 and all other just relief. They are represented by the Law Offices of Bernard M. Gross PC in Philadelphia.
