PHILADELPHIA — An American Airlines passenger alleges she suffered a concussion after a flight attendant dropped a piece of luggage from the overhead compartment onto her head.
Toni Giordano filed a complaint Nov. 4 in the U.S. District Court for the Eastern District of Pennsylvania against American Airlines Inc., c/o CT Corporation Systems alleging negligence.
Giordano was a passenger on an American Airlines flight traveling from Philadelphia International Airport to Boston's Logan International Airport on Nov. 9, 2019. She alleges that after the plane reached its designated gate at Logan, an American Airlines flight attendant who was helping an elderly passenger remove her overhead luggage dropped the luggage on her head.
Giordano claims as a result of the accident, she suffered a closed head injury, concussion, cognitive impairment, short term memory loss, light and noise sensitivity as well as headaches and equilibrium issues and injuries to her spine, neck and arm. She alleges the American Airlines flight attendant negligently attempted to remove a suitcase from the overhead compartment that was too heavy and without properly grasping the luggage. Giordano also alleges the flight attendant failed to warn her or clear the area below the overhead compartment and that American Airlines negligently allowed the elderly passenger who was incapable of handling the suitcase to carry on the luggage.
Giordano seeks monetary relief of more than $75,000, trial by jury and all other just relief. She is represented by Andrew Motel of The Law Office of Andrew P. Motel LLC in West Chester.
