Woman who slipped outside post office in Philadelphia files lawsuit

PHILADELPHIA — A woman is alleging the City of Philadelphia and others' negligence after she suffered injuries from a broken sidewalk outside a U.S Post Office building. 

Barbara Fulton filed a complaint Nov. 4 in the U.S. District Court for the Eastern District of Pennsylvania against the United States Postal Service, United States Postal Service National Tort Center, Vicinity Energy Philadelphia Inc., the City of Philadelphia and John Does 1 & 2 alleging negligence.

According to her complaint, Fulton was at the U.S. Post Office on Rising Sun Avenue in Philadelphia on Nov. 7, 2019. She alleges that the defendants negligently allowed an "elevated and/or raised and/or excavation and/or broken" and dilapidated sidewalk or sewer grate to exist on the premises which caused her to suffer severe injuries. Fulton further alleges the defendants knew or should have known that the defective condition existed, failed to warn of the hazard and failed to inspect the sidewalk/sewer grate and repair the dangerous condition. 

Specifically, she alleges the City of Philadelphia's and Vicinity Energy's negligence for failing to provide a safe passageway and failing to hire competent contractors to repair and replace the sidewalk/sewer gate. 

Fulton seeks monetary and all other just relief. She is represented by Adam Grutzmacher.
