Hispanic American Airlines worker alleges discrimination, retaliation

PITTSBURGH — An American Airlines worker alleges he faced discrimination and retaliation because he is Hispanic. 

Lenin Rodriguez filed a complaint Nov. 2 in the U.S. District Court for the Eastern District of Pennsylvania against American Airlines Inc., alleging civil rights violations and other claims.

Rodriguez was hired as fleet service agent for American Airlines on April 2, 2012, according to his complaint. He alleges that in December of 2018, he was involved in a car accident and had started a new position which caused him to be on a "new hire probation." 

Rodriguez further alleges that in March of 2019, he took medical leave and in April of 2019, underwent spinal surgery. He claims he was fired on April 4, 2019, and rehired in September of 2019, but was told his medical insurance would not be reinstated. 

Rodriguez alleges he was treated differently because he is Hispanic including not getting the same training as his co-workers and not allowing him to come back to work after he required restrictions due to his medical issues. According to his suit, he filed a Charge of Discrimination with the EEOC in July of 2021.

Rodriguez seeks monetary relief of more than $150,000, interest, trial by jury and all other just relief. He is represented by Mary Lemieux-Fillery of The Law Offices of Eric A. Shore PC in Philadelphia.
