PITTSBURGH — A Pennsylvania-based ladder manufacturer is facing a claim its defective product caused a man's fall.
Gregory Segalini filed a complaint Nov. 17 in the Court of Common Pleas of Allegheny County against WernerCo and New Werner Holding Co., Inc., alleging strict liability, breach of express warranty and other claims.
Segalini was using a 17-foot Werner Ladder on Dec. 1, 2019, while painting a garage, according to his complaint. He claims the ladder suddenly broke and caused him to "violently" fall to the ground and suffer serious injuries including a broken ankle as well as injuries to his foot.
Segalini alleges that despite the defendant's claim of its ladder being able to safely hold 375 pounds, it knew or should have known that the ladder could give way while under the weight limit. He also alleges the ladder is defectively designed and that the defendants failed to warn or have adequate warnings in the instructions and failed to test the ladder.
He alleges he purchased the ladder with the reasonable expectation that it was properly designed and free of any defects.
Segalini seeks monetary relief, interest, trial by jury and all other just relief. He is represented by Eric Chaffin, Patrick Booth and Justin Joseph of Chaffin Luhana LLP in Oro Valley, Arizona.
