Intoxicated man who fell down stairs sues country club, says it should have cut him off

PITTSBURGH – A man who became intoxicated at a country club and fell down a flight of stairs is claiming Dram Shop Act violations. 

Gary Perrotte filed a complaint Jan. 5 in the Court of Common Pleas of Allegheny County against Shannopin Country Club alleging negligence and violation of the Dram Shop Act. 

Perrotte was a guest at the Shannopin Country Club on Nov. 25, 2020, according to his complaint. He claims that he was served and consumed alcohol and became "visibly intoxicated." He claims that despite being intoxicated, the country club's staff continued to serve him and that he had a blood alcohol concentration of .282. 

He further claims that as he left the premises, he fell down a flight of 25 stairs and struck his head. Perrotte alleges he was knocked unconscious and was not located for about 25 minutes and required resuscitation by emergency personnel. 

He also alleges he continues to suffer from seizures and other health issues which have caused his driver's license to be revoked. Perrotte claims the defendants failed to properly illuminate the stairway and clear the area of debris. He also claims the defendants should not have continued to serve him alcohol while he was visibly intoxicated.

Perrotte seeks monetary relief of more than $35,000, interest and all other just relief. He is represented by Mark Gordon of Pietragallo Gordon Alfano Bosick & Raspanti LLP in Pittsburgh.
