PITTSBURGH — A worker alleges she was fired for reporting her company's failure to follow proper COVID-19 testing and protocols. 

Eliana Davis Filed a complaint Jan. 17 in the U.S. District Court for the Western District of Pennsylvania against Creative Dialogues LLC alleging violation of the Pennsylvania Whistleblower Law, wrongful termination and other claims.

Davis began working for Creative Dialogues as a direct support professional on Jan. 12, 2021, and assisted a minor who has autism with daily tasks in her home, according to her complaint. She alleges that on Dec. 6, 2021, she discovered her client had been exposed to one of her coworkers who tested positive for COVID-19. 

Davis further claims that she sent a company group chat via text message to report the exposure of her client and that her supervisor deleted her report of the exposure and "verbally berated" for the report. Davis alleges prior to seeing her client for the next scheduled visit, she requested proof of her client's negative COVID test and was denied by her supervisor. 

She also alleges that on Dec. 10, 2021, she was fired as a result of her formal report.

Davis seeks monetary relief, trial by jury and all other just relief. She is represented by Joshua Ward of J.P. Ward & Associates LLC in Pittsburgh.
