MEDIA — A contractor alleges he was falsely arrested and accused of stealing from a Home Depot store in Norristown.
Glen Holmes filed a complaint Dec. 16 in the Court of Common Pleas of Delaware County against The Home Depot Inc., and Home Depot USA Inc., alleging negligence, intentional infliction of emotional distress and false imprisonment.
Holmes, according to his complaint, was working as a contractor at a home in West Norton. He alleges that he drove to the Home Depot in Norristown along with a co-worker and used his credit card to purchase more than $200 worth of materials.
Holmes claims that as he left the self check-out with his items and began to exit the store, he was approached by store security. He further claims security personnel demanded he empty his pockets and that he refused and left the store parking lot.
Holmes alleges that West Norristown police officers then came to his home and asked to see his bags of purchases and receipt and informed him that the co-worker stole drill bits from the Home Depot. He claims he was never in the drill bit aisle and allowed the police to search his work truck, where no drill bits were found. Holmes alleges he was falsely arrested, in custody most of the day and given a citation for retail theft. The charges were then dismissed at a hearing, the suit says.
Holmes seeks monetary relief of more than $50,000 and all other just relief. He is represented by James Famiglio of The Law Offices of James D. Famiglio PC in Media.
