Man claims Dram Shop violations against bars that served him while he was intoxicated

MEDIA — A man is alleging Dram Shop violations against the establishments that served him alcohol while he was intoxicated. 

Malcolm Hughes filed a complaint Jan. 24 in the Court of Common Pleas Delaware County against MikeJohnny's Sports Bar, The Railway Cafe and 98 N. 5th Darby Inc., alleging Dram Shop liability and other claims. 

Hughes alleges in his suit that on Jan. 31, 2020, he was permitted to become "visibly intoxicated" while at the defendants' premises. He alleges he fell to the ground and was unable to properly sit in a seat/stool in a safe manner after being served alcoholic beverages. 

Hughes claims the defendants negligently furnished him alcohol while he was intoxicated and alleges they failed to implement disciplinary actions for the employees regarding the sale of alcohol and hired incompetent and unqualified managers. He further claims the staff and/or patrons "physically" lifted him up and threw him outside onto the concrete while he was unable to walk due to a spinal injury. 

Hughes seeks monetary and all other just relief. He is represented by Frank Bizzari, III and Keith Kofsky of Clearfield & Kofsky in Philadephia.
